Abstract

Bantuan Operasional Sekolah (BOS) merupakan dana yang dialokasikan untuk membantu kebutuhan belanja operasional seluruh Peserta Didik pada satuan pendidikan dasar dan menengah. Salah satu penerima bantuan dana tersebut adalah SMA Negeri 1 Bangun Purba. Pada tahun 2020, sekolah ini menerima jumlah alokasi anggaran sebesar Rp 832.500.000,00. Anggaran tersebut digunakan sekolah telah sesuai dengan RKAS. Selain itu, adanya pandemi covid-19 membuat kegiatan belajar menjadi terhambat sehingga pemerintah dalam hal ini Kementerian Pendidikan dan Kebudayaan merevisi aturan sebelumnya yang telah ditetapkan. Perubahan tersebut difokuskan pada fleksibilitas alokasi dana BOS untuk menanggulangi dan mencegah pandemi yang semakin meluas. Tujuan penelitian ini adalah untuk mengetahui pengelolaan BOS, efektivitas kebijakan dari segi hukum, serta hambatan dalam perencanaan hingga pertanggungjawaban dana BOS di SMA Negeri 1 Bangun Purba. Efektivitas hukum pada penelitian ini didasarkan pada 5 faktor yang diuraikan oleh Soerjono Soekanto. Faktor-faktor tersebut meliputi faktor hukumnya sendiri, faktor penegakan hukum, faktor sarana dan prasarana pendukung, faktor masyarakat, dan faktor kebudayaan. Hasil penelitian menunjukkan bahwa SMA Negeri 1 Bangun Purba belum menerapkan faktor-faktor yang menjadi ukuran efektivitas hukum secara efektif./ Bantuan Operasional Sekolah (BOS) is a fund allocated to assist the operational expenditure needs of all students in primary and secondary education units. One of the recipients of the financial assistance was SMA Negeri 1 Bangun Purba. In 2020, this school received a total budget allocation of IDR 832,500,000.00. The school budget is used in accordance with RKAS. In addition, the Covid-19 pandemic has hampered learning activities so that the government, in this case the Ministry of Education and Culture, has revised the previous rules that have been set. This change is focused on the flexibility of the allocation of BOS funds to cope with and prevent an increasingly widespread pandemic. The purpose of this study was to determine the management of BOS, the effectiveness of policies from a legal perspective, as well as obstacles in planning and accountability for BOS funds at SMA Negeri 1 Bangun Purba. The effectiveness of the law in this study is based on the 5 factors described by Soerjono Soekanto. These factors include the legal factors themselves, law enforcement factors, supporting facilities and infrastructure factors, community factors, and cultural factors. The results show that SMA Negeri 1 Bangun Purba has not implemented the factors that become a measure of the effectiveness of the law effectively.
