Abstract

Kondisi gagal bayar PT. Asuransi Jiwasraya dijadikan sebagai kasus tindak pidana korupsi yang menyebabkan kerugian negara, sehingga diperlukannya pemulihan aset melalui lelang eksekusi berupa barang rampasan yang dilaksanakan di KPKNL Jakarta IV. Penelitian ini bertujuan untuk mengetahui pelaksanaan lelang eksekusi barang rampasan PT. Asuransi Jiwasraya, mengetahui faktor-faktor yang menjadi penyebab tidak lakunya barang rampasan pada pelaksanaan lelang pertama dan mengetahui tindak lanjut serta alternatif penyelesaian atas objek lelang barang rampasan yang tidak laku terjual pada pelelangan pertama. Metode penelitian yang digunakan adalah studi kepustakaan, wawancara, dan observasi. Hasil penelitian menunjukkan bahwa pelaksanaan lelang eksekusi barang rampasan milik PT. Asuransi Jiwasraya sudah sudah sesuai dengan peraturan yang berlaku, faktor yang menjadi penyebab tidak lakunya barang rampasan pada pelelangan pertama yaitu kondisi barang yang sudah mengalami penyusutan dan barang yang dijual tergolong barang mewah sehingga memiliki nilai limit yang tinggi, dan tindak lanjut atas barang yang belum terjual pada pelalangan pertama yaitu dengan dilakukan lelang ulang yang diharapkan nilai limitnya dapat turun./ PT. Asuransi Jiwasraya was used as a corruption case that caused state losses, so that asset recovery was needed through an execution auction in the form of booty which was held at KPKNL Jakarta IV. This study aims to determine the implementation of the auction of the execution of the booty of PT. Asuransi Jiwasraya, knowing the factors that caused the looted goods to not be sold at the first auction and knowing the follow-up and alternative settlements for the object of the looted auction that were not sold at the first auction. The research method used is literature study, interview, and observation. The results showed that the implementation of the auction of the execution of the booty belonging to PT. Asuransi Jiwasraya has complied with the applicable regulations, the factors that caused the failure to sell the stolen goods at the first auction were the condition of the goods that had experienced depreciation and the goods sold were classified as luxury goods so that they had a high limit value, and follow-up on goods that had not been sold. in the first auction, by re-auctioning, it is hoped that the limit value will decrease.
