Abstract
Karya Tulis Tugas Akhir ini bertujuan untuk meninjau kesesuaian proses hibah BMN oleh Rumah Tahanan Kelas IIB Trenggalek kepada Pemerintah Daerah Kabupaten Trenggalek dengan PMK Nomor 111/PMK.06/2016 jo. PMK Nomor 165/PMK.06/2021 tentang Tata Cara Pelaksanaan Pemindahtanganan Barang Milik Negara serta mengetahui permasalahan yang muncul selama proses hibah. Metode pengumpulan data dilakukan dengan melakukan studi pustaka serta wawancara kepada pengelola BMN pada Rumah Tahanan Kelas IIB Trenggalek sebagai pengguna barang yang melaksanakan proses hibah. Periode pengumpulan data dilakukan pada bulan Februari hingga Maret tahun 2022. Wawancara dilakukan untuk mengetahui tiga pertanyaan utama, yaitu : (1) proses hibah BMN, (2) kesesuaian antara proses hibah dengan PMK, serta (3) permasalahan yang terjadi selama proses hibah. Terdapat dua objek BMN yang dihibahkan, yaitu Tanah Bangunan Rumah Negara Golongan I dan Rumah Negara Golongan I Tipe A Permanen. Keduanya diperuntukkan sebagai Gedung Kantor Kesbangpol Kabupaten Trenggalek. Proses hibah diawali dengan adanya Surat Bupati tentang Rencana Relokasi Rumah Dinas Kepala Rutan Kelas IIB Trenggalek pada tahun 2002. Kemudian akan dilakukan skema tukar menukar BMN namun skema ini tidak mencapai tahap serah terima sehingga dibatalkan. Selanjutnya Pemerintah Daerah Kabupaten Trenggalek mengusulkan untuk dilakukan skema saling hibah, yang mana Rumah Tahanan Kelas IIB Trenggalek menghibahkan BMN kemudian setelah proses tersebut selesai dilanjutkan dengan Pemerintah Daerah Kabupaten Trenggalek yang menghibahkan BMN-nya. Proses hibah tersebut tidak sesuai dengan definisi hibah menurut peraturan perundang-undangan, namun sesuai dengan aturan mengenai peruntukkan, persyaratan, pihak, serta tata cara hibah. Permasalahan dalam proses hibah ini adalah jangka waktu yang sangat lama hingga hibah mendapatkan persetujuan dari KPKNL Malang serta skema tukar menukar yang batal dilakukan karena adanya kesulitan persyaratan penentuan nilai aset yang sama dan adanya beberapa kali perubahan peraturan mengenai pengelolaan BMN./ This Final Project aims to review the suitability of the process of granting State Property by the Detention Center Class IIB of Trenggalek to the Trenggalek Regency Government with PMK Number 111/PMK.06/2016 jo. PMK Number 165/PMK.06/2021 concerning Procedures for the Implementation of the Transfer of State Property and to find out the problems that arise during the grant process. The data collection method is by conducting a literature study and interviewing the manager of State Property at the Detention Center Class IIB of Trenggalek as the user of the State Property who carried out the grant process. The data collection period was from February to March 2022. Interviews were conducted to determine three main questions, namely: (1) the process of granting State Property, (2) the suitability of the grant process with PMK, and (3) Problems occurred during the grant process. Two objects of State Property are granted, namely Land for Building Class I State Houses and Type-A Permanent State Houses. Both are designated as the Trenggalek Regency Kesbangpol Office Building. The grant process began with a letter from the Regent regarding the Plan for Relocation of the Official House of the Detention Center Class IIB of Trenggalek in 2002. Then a State Property Exchange scheme would be carried out, but it did not reach the handover stage, so it was canceled. Furthermore, the Trenggalek Regency Government proposed a mutual grant scheme in which the Detention Center Class IIB of Trenggalek granted State Property. Then, after the process was completed, the Trenggalek Regency Regional Government granted its State Property. The grant process is not suitable with the definition of a grant according to the laws and regulations. However, the rules regarding the designation, requirements, parties, and grant procedures are suitable. Problems in this grant process are the very long period until the grant gets approval from the KPKNL Malang and the exchange scheme that was canceled due to difficulties in determining the exact asset value requirements and several changes to regulations regarding State Property management.
