Abstract

Di dalam bidang kepabeanan, barang impor atau ekspor dapat diberikan status menjadi Barang yang Dinyatakan Tidak Dikuasai (BTD), Barang yang Dikuasai Negara (BDN), atau Barang yang Menjadi Milik Negara (BMMN) apabila telah memenuhi kriteria yang ditentukan oleh Undang-undang Kepabeanan. Pemberian status ini ditujukan agar Direktorat Jenderal Bea dan Cukai dapat melakukan penyelesaian terhadap suatu barang impor atau ekspor guna mengurangi penumpukan di tempat penimbunan. Pelelangan merupakan salah satu jenis penyelesaian terhadap masing-masing ketiga status tersebut. Tujuan dari penelitian ini adalah untuk mengetahui kesesuaian teori dan peraturan-peraturan terkait pelelangan BTD, BDN, dan BMMN dengan pelaksanaannya, hak negara dalam pelelangan BTD, BDN, dan BMMN dari segi penerimaan negara, dan mengidentifikasi permasalahan-permasalahan dan prestasi yang terjadi dalam proses bisnis penyelesaian BTD, BDN, dan BMMN di KPUBC Tipe A Tanjung Priok dengan cara pelelangan. Metode penelitian yang digunakan untuk mengumpulkan data adalah melalui riset kepustakaan, observasi, dan wawancara. Hasil dari penelitian mendapati bahwa pelelangan BTD, BDN, dan BMMN di KPUBC Tipe A Tanjung Priok telah sesuai dengan peraturan-peraturan yang berlaku namun masih memerlukan perbaikan di beberapa hal agar pelelangan BTD, BDN, dan BMMN dapat dilakukan dengan efektif dan efisien. In the field of customs, imported or exported goods can be given the status of unclaimed goods, goods claimed by the state, or goods that become state property if they meet the criteria determined under Customs Law. The granting of this status is intended so that the Directorate General of Customs and Excise can carry out completion for imported or exported goods to reduce storage occupancy. Auction is one type of completion for each of the three statuses above. The purpose of this study is to determine the suitability of the theory and regulations related to the auction of unclaimed goods, goods claimed by the state, and goods that become state property to its implementation, to determine the state's rights in the auction of unclaimed goods, goods claimed by the state, or goods that become state property in terms of revenue, and identify the problems and achievements that occur in the completion process of unclaimed goods, goods claimed by the state, or goods that become state property at KPUBC Tipe A Tanjung Priok. The research method used to collect data is through library research, observation, and interviews. The results of the study found that the auctions of unclaimed goods, goods claimed by the state, or goods that become state property at KPUBC Tipe A Tanjung Priok complied with the applicable regulations but still needed improvement in several respects so that the auctions could be carried out effectively and efficiently.
