Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana bentuk-bentuk penyelesaian Aset Bekas Milik Asing/Tionghoa (ABMA/T) pada Kantor Wilayah DJKN Sumatera Utara, serta mengidentifikasi apa saja permasalahan yang ditemui oleh Kanwil dalam penyelesaian ABMA/T dan bagaimana tanggapan dari Kawil DJKN Sumatera Utara. Penelitian ini menggunakan metode kepustakaan, wawancara, dan observasi langsung di Kanwil DJKN Sumatera Utara. Adapun jenis data dalam karya tulis tugas akhir ini adalah data kualitatif dalam bentuk kata verbal. Sumber data yang digunakan adalah data primer yang disajikan oleh Kanwil DJKN Sumatera Utara dan data sekunder dari penelitian yang pernah dilakukan sebelumnya. Hasil penelitan menunjukkan bahwa penyelesaian Aset Bekas Milik Asing/Tionghoa (ABMA/T) terdiri atas empat bentuk, yakni dimantapkan status hukumnya menjadi BMN/D, diserahkan kepada pihak ketiga dengan pembayaran kompensasi, diserahkan kepada pihak ketiga yang sah, atau dinyatakan selesai akibat keadaan tertentu. Setiap bentuk penyelesaian ini memerlukan dokumen persyaratan dalam pengusulan penyelesaiannya. Sebanyak 74 dari 139 Aset Bekas Milik Asing/Tionghoa (ABMA/T) saat ini belum terselesaikan pada Kantor Wilayah DJKN Sumatera Utara. Hal ini dikarenakan terdapat beberapa kendala sehingga penyelesaiannya tertunda. Permasalahan ini antara lain kurangnya kesadaran dan kemauan pengguna aset untuk mengajukan usulan penyelesaian serta penerbitan dokumen persyaratan yang lama. Selain itu, terdapat perbedaan ukuran aset akibat keadaan tertentu. Untuk itu, Kanwil DJKN Sumatera Utara menerbitkan regulasi berupa keringanan, meningkatkan koordinasi, dan mendukung keaktivan Tim Asistensi Daerah, serta menyusun rencana kerja sehingga penyelesaian atas ABMA/T ini dapat segera selesai dalam kurun waktu empat tahun ke depan. / This study aims to find out how the forms of settlement of Used Foreign/Chinese-Owned Assets (ABMA/T) at the North Sumatra DJKN Regional Office are, as well as identify the problems encountered by the Regional Office in the settlement of ABMA/T and how the response from the Regional Office of DJKN North Sumatra. This study uses the method of literature, interviews, and direct observation at the North Sumatra DJKN Regional Office. The type of data in this thesis is qualitative data in the form of verbal words. Sources of data used are primary data presented by the North Sumatra DJKN Regional Office and secondary data from previous research. The results of the research show that the settlement of Foreign/Chinese-Owned Used Assets (ABMA/T) consists of four forms, namely, the legal status is confirmed to be State or Regional Property, handed over to a third party with compensation payments, handed over to a legitimate third party, or declared completed due to certain circumstances. Each form of settlement requires required documents in proposing its completion. As many as 74 of the 139 Chinese Foreign-Owned Used Assets (ABMA/T) are currently unresolved at the North Sumatra DJKN Regional Office. This is because there are several obstacles so that the completion is delayed. These problems include the lack of awareness and willingness of asset users to submit proposals for settlement and the issuance of old required documents. In addition, there are differences in the size of assets due to certain circumstances. For this reason, the North Sumatra DJKN Regional Office issued regulations in the form of waivers, improving coordination, and supporting the activities of the Regional Assistance Team, as well as preparing a work plan so that the completion of this ABMAT can be completed within the next four years.
