Abstract

Lelang Eksekusi Wajib Benda Sitaan Pasal 45 KUHAP adalah lelang benda sitaan yang memiliki sifat cepat rusak, busuk, membahayakan, atau jika disimpan telalu lama akan menimbulkan biaya penyimpanan yang terlalu tinggi sehingga tidak mungkin untuk disimpan sampai putusan pengadilan terhadap perkara yang bersangkutan memperoleh kekuatan hukum tetap. Penelitian ini mengangkat topik pelaksanaan Lelang Eksekusi Wajib Benda Sitaan Pasal 45 yang bertujuan untuk mengetahui pelaksanaan Lelang Eksekusi Wajib Benda Sitaan Pasal 45 KUHAP atas aset PT. ASABRI (Persero) yang telah dilaksanakan di Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL) Jakarta IV. Selain itu, penelitian ini juga membahas faktor-faktor yang menyebabkan tidak terjualnya objek lelang dan bagaimana tindak lanjut dari tidak terjualnya objek tersebut. Penelitian ini dilakukan dengan menggunakan metode kualitatif deskriptif. Hasil dari penelitian ini menunjukkan bahwa dalam pelaksanaan Lelang Eksekusi Wajib Benda Sitaan Pasal 45 KUHAP telah dilaksanakan sesuai peraturan dalam PMK 213 Tahun 2020 tentang Petunjuk Pelaksanaan Lelang dan juga peraturan teknis pada Perdirjen KN Nomor 2/KN/2017 tentang Petunjuk Teknis Pelaksanaan Lelang serta Perdirjen KN Nomor 3/KN/2020 tentang Panduan Pemberian Layanan Lelang Pada KPKNL Saat Keadaan Darurat Bencana Wabah Penyakit Akibat Corona Virus Disease 2019 (COVID-19). Namun, masih terdapat hal yang dapat diperbaiki yaitu terkait penyebarluasan informasi terkait pelaksanaan lelang yang dilaksanakan di KPKNL Jakarta IV melalui media sosial agar masyarakat mengetahui terkait lelang dan tertarik untuk mengikuti pelaksanaan lelang yang diselenggarakan di KPKNL Jakarta IV / Mandatory Execution Auction for Confiscated Goods Article 45 of the Criminal Procedure Code is an auction of confiscated objects that are quickly damaged, rotten, dangerous, or if stored for too long will cause storage costs that are too high so that it is impossible to store them until the court's decision on the case concerned obtain permanent legal force. . This research raises the topic of the implementation of Article 45 of the Mandatory Execution Auction for Confiscated Goods which aims to determine the implementation of the Article 45 of the Criminal Procedure Code for the implementation of the Mandatory Execution of Confiscated Goods for the assets of PT. ASABRI (Persero) which has been carried out at the Office of the State Assets and Auction Service (KPKNL) Jakarta IV. In addition, this study also discusses the factors that cause the auction object to be unsold and how to follow up on the unsold object. This research was conducted using the descriptive qualitative method. The results of this study indicate that in the implementation of the Mandatory Execution Auction for Confiscated Objects Article 45 of the Criminal Procedure Code has been carried out by the regulations in PMK 213 of 2020 concerning Auction Implementation Guidelines and also technical regulations in Perdirjen KN Number 2/KN/2017 concerning Technical Instructions for Auction Implementation and Perdirjen KN Number 3/KN/2020 concerning Guidelines for Providing Auction Services at KPKNL during an Emergency Disaster Outbreak of Diseases Due to Corona Virus Disease 2019 (COVID-19). However, there are still things that can be improved, namely the dissemination of information related to the auction held at KPKNL Jakarta IV through social media so that the public knows about the auction and is interested in participating in the auction held at KPKNL Jakarta IV.
