Abstract

Penelitian ini bertujuan untuk meninjau pelaku dan pelaksanaan Pengadaan Barang/Jasa dengan metode Pengadaan Langsung pada Stasiun Pengawasan Sumber Daya Kelautan dan Perikanan (PSDKP) Belawan pada tahun anggaran 2021 yang akan ditinjau kesesuaiannya dengan Peraturan Presiden Nomor 12 Tahun 2021 tentang Perubahan atas Peraturan Presiden Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah, Peraturan Presiden Nomor 70 Tahun 2012 tentang Perubahan Kedua atas Peraturan Presiden Nomor 54 Tahun 2010 tentang Pengadaan Barang/jasa Pemerintah, dan Peraturan Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah (LKPP) Nomor 12 Tahun 2021 tentang Pedoman Pelaksanaan Pengadaan Barang/Jasa Pemerintah Melalui Penyedia. Metode analisis yang digunakan adalah analisis kualitatif. Hasil penelitian menyatakan bahwa secara umum pelaku dan pelaksanaan pengadaan barang/jasa pada Stasiun PSDKP Belawan telah sesuai dengan Peraturan Presiden Nomor 12 Tahun 2021, Peraturan Presiden Nomor 70 Tahun 2012, dan Peraturan LKPP Nomor 12 Tahun 2021. Walaupun demikian, terdapat beberapa temuan penulis yang perlu menjadi perhatian dalam pelaksanaan di masa depan. Pertama, tidak adanya pihak yang benar-benar ahli dalam masalah Pengadaan. Kedua, kurangnya sosialisasi atau pelatihan terkait aturan-aturan baru sehingga mengakibatkan terjadinya kesalahan pelaksanaan pengadaan karena belum di-update aturan-aturan yang baru. Terakhir, dokumen SPK yang belum dijilid./This research aims to review the parties involved and implementation of the Procurement of Goods/Services using the Direct Procurement method at the Belawan Marine and Fisheries Resources Supervision Station in the 2021 fiscal year which will be reviewed for compliance with Presidential Regulation No. 12 of 2021 concerning Amendments to Presidential Regulation No. 16 of 2018 concerning Government Procurement of Goods/Services, Presidential Regulation No. 70 of 2012 concerning the Second Amendment to Presidential Regulation No. 54 of 2010 concerning Government Procurement of Goods/Services, and Regulation of the National Public Procurement Agency (LKPP) No. 12 of 2021 concerning Guidelines for the Implementation of Government Procurement of Goods/Services through Providers. The analytical method used in this research is qualitative analysis. The results of the research stated that in general, the parties involved and the implementation of the procurement of goods/services at the Belawan PSDKP Station were in accordance with Presidential Regulation No. 12 of 2021, Presidential Regulation No. 70 of 2012, and LKPP Regulation Number 12 of 2021. However, there are several author's findings that need to be considered in future implementation. First, the absence of a party who is truly an expert in procurement issues. Second, the lack of socialization or training related to the new rules resulted in procurement implementation errors because the new rules had not been updated. Finally, SPK documents that have not been bound.
